Wassily v. Blanche
U.S. Supreme Court (from the 2nd Circuit), No. 25-842
Where it stands
Cert. granted June 29, 2026. The government filed its merits brief in October 2026.
Next up, Nov 30, 2026
Oral argument.
The question
Can a noncitizen who was granted asylum, but whose asylum was later terminated, still apply to become a lawful permanent resident under 8 U.S.C. § 1159(b)?
Why it matters
The circuits are split. The Fifth Circuit says yes, and the Second and Fourth say such people are categorically ineligible. The ruling sets one national rule for everyone whose asylum was terminated.
